This appendix contains selected state laws that seem to be applicable to the area of privacy of student records and general data transmission security. The lists are provided for the reader to use as a starting place for research. The lists for each state are not exhaustive, and we do not guarantee that the statutes are current.  However, they do give readers an idea of the kinds of statutes that states may have on their books.

Protection of public records.

Summary: See (1) which refers to maintaining public records in machine readable or electronic form and (2) which states the custodian of the records may adopt rules to protect those records.

ORS § 409.225 (Oregon Revised Statutes)

Confidentiality of records regarding children.

Summary: See (1) which states that the State Office for Services to Children and Families shall not disclose the contents of any records about an individual child. See (2) & (3) which discuss when a record involving a child can be disclosed and (4) which states that the disclosed information must remain confidential.

ORS § 419A.015 (Oregon Revised Statutes)

Juvenile records; reports to school districts.

Summary: See all of statute regarding disclosing information on youth offenders to school district. See (4) regarding the school district's responsibility to disclose the information only to those school employees who need to know in order to safeguard the safety and security of the school.

Disclosing personally identifiable information regarding a student.

Summary: See all of statute which states that

"a public school or school district can disclose personally identifiable information from an education record of a student to law enforcement, child protective services and health care professionals in connection with a health or safety
