This appendix contains selected state laws that seem to be applicable to the area of privacy of student records and general data transmission security. The lists are provided for the reader to use as a starting place for research. The lists for each state are not exhaustive, and we do not guarantee that the statutes are current.  However, they do give readers an idea of the kinds of statutes that states may have on their books.

Tenn. Code Ann. § 49-6-3051 (Tennessee Code Annotated)

Notice to school of child's criminal offense; confidentiality.

Summary: See all of statute which states that when a student initially enrolls in a local education agency, or resumes school attendance after a disciplinary suspension or expulsion, that the parents or guardians of the student must notify in writing the school principal why the student was disciplined and inform him of any other criminal offenses the student is guilty of. This information can be shared with those who instruct the student but otherwise is confidential and shall not become a part of the student's permanent education record.

Tenn. Code Ann. § 49-6-4213 (Tennessee Code Annotated)

School records; drug test results.

Summary: See (j)(2) which states that if a student is tested for drug use and the results of the test are negative, then all records of the test, requests for a test, or indications a student was tested will be expunged from all school records.
